Photography Services Contract

This Photography Services Contract ("Agreement") is entered into between EJS Tech ("Photographer") and Jane Smith ("Client") for the photography session described below.

The Photographer agrees to provide professional photography services for the session described above. Deliverables, including edited digital photographs, will be delivered to the Client within the timeframe communicated at the time of booking. The exact number of delivered images is at the Photographer's professional discretion and will reflect the quality and variety of images captured during the session.
Images will be delivered via the EJS Tech online gallery. The Client will receive a private link to access, download, and share their photographs.
Total Session Fee: $350.00
Deposit Paid: $175.00
Remaining Balance: $175.00
The deposit is due at the time of booking and is required to reserve the Client's session date and time. The remaining balance is due as communicated in the booking confirmation. Failure to pay the remaining balance may result in withholding of final images.
All payments are non-refundable except as described in Section 4 (Cancellation Policy) below.
Cancellations by Client: If the Client cancels the session more than 72 hours before the scheduled time, a session credit equal to the deposit paid will be issued for use toward a future session. Cancellations within 72 hours of the session are non-refundable and non-transferable.
Rescheduling by Client: The Client may reschedule a session one (1) time at no additional charge, provided the request is made at least 48 hours before the session. Subsequent rescheduling requests may incur a $25 administrative fee.
Cancellations by Photographer: In the unlikely event the Photographer must cancel, the Client will receive a full refund of all payments made or be offered the option to reschedule at no additional cost.
For outdoor sessions, if severe weather conditions make photography impractical or unsafe, the Photographer reserves the right to reschedule the session. Both parties will work together in good faith to find an alternative date. Light overcast conditions are generally excellent for photography and are not grounds for rescheduling.
The Photographer retains full copyright ownership of all photographs produced under this Agreement. The Client is granted a non-exclusive, personal-use license to print, display, and share the delivered photographs for personal, non-commercial purposes.
The Client may not sell, license, or use the photographs for commercial purposes without prior written consent from the Photographer. The Photographer reserves the right to use the photographs for portfolio, marketing, website, and social media purposes unless the Client requests otherwise in writing prior to the session.
By signing this Agreement, the Client grants EJS Tech and EJS Tech permission to use the photographs taken during this session for promotional purposes, including but not limited to: the studio's website, social media accounts, printed marketing materials, and portfolio displays. If the Client does not wish for their images to be used for promotional purposes, they must notify the Photographer in writing prior to the session date.
The Client agrees to arrive on time for the scheduled session. Late arrivals may result in a reduced session time with no adjustment to the agreed fee. The Client is responsible for the appearance and preparedness of all subjects being photographed, including clothing, grooming, and any props.
The Client agrees to cooperate with the Photographer's direction to achieve the best possible results. The Photographer cannot guarantee specific results if the Client or subjects are uncooperative.
All delivered photographs will be professionally edited by the Photographer according to their artistic style. The editing process includes color correction, exposure adjustment, and basic retouching. Additional retouching requests beyond the standard level of editing may be accommodated for an additional fee.
RAW (unedited) files are not included in or available as part of this Agreement.
The Photographer's total liability to the Client under this Agreement shall not exceed the total fees paid by the Client. The Photographer is not responsible for failure to deliver photographs due to circumstances beyond their reasonable control, including but not limited to equipment failure, memory card malfunction, extreme weather, or other unforeseen events. In such cases, the Photographer will make every reasonable effort to recover images and notify the Client promptly.
The Client releases EJS Tech and EJS Tech from any liability for injury, accident, or damage that occurs during the photography session.
This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, understandings, or agreements. Any modifications to this Agreement must be made in writing and signed by both parties.
By signing below, the Client acknowledges they have read, understood, and agree to all terms and conditions set forth in this Photography Services Contract.
